These terms
These terms set out how Kearney Landscapes provides garden design and landscaping services. By requesting a quote or engaging us to carry out work, you agree to them. They are illustrative for this demonstration website.
Quotes and pricing
Quotes are provided in writing after a site visit and are valid for 30 days. The price is fixed for the work specified in the quote. Where ground conditions or your requirements change once work is under way, any additional cost is agreed with you in writing before we proceed.
Deposits and payment
For construction projects we typically ask for a deposit to secure your date and cover materials, with the balance due on completion. Payment terms are set out in your quote. We accept bank transfer and card.
Our guarantees
We guarantee all planting we supply and plant for three years against failure through no fault of care, and all hard landscaping, including patios and stone walls, for ten years against defects in workmanship. The guarantee does not cover damage, neglect, or failure to follow the aftercare advice we provide.
Your responsibilities
You agree to provide safe access to the site, to confirm the position of any underground services you are aware of, and to obtain any planning permission required for the work. We will advise where permission may be needed, but responsibility for obtaining it rests with you.
Design ownership
Where we produce a garden design, the design remains our intellectual property until paid for in full. Once paid, the design is yours to use. The design fee is credited against the construction cost where you engage us to build the garden.
Liability
We carry €6.5m public liability insurance. Our liability is limited to the value of the contract and does not extend to indirect or consequential loss. Nothing in these terms limits liability for death or personal injury caused by negligence, or anything that cannot be limited by law.
Governing law
These terms are governed by the law of Ireland, and any dispute is subject to the jurisdiction of the Irish courts. For any question, contact us at info@kearneylandscapes.ie.
